Terms of service

These terms govern your use of Foreman. By signing up you agree to them. If you do not agree, do not use the service.

1. Who we are

Foreman is operated by Luke Pledger, a sole trader trading as “Foreman” from the United Kingdom. References to “we”, “us” and “Foreman” mean the operator. References to “you” mean the tradesperson who has signed up to use the service.

2. What Foreman is

Foreman is a software service for self-employed tradespeople in the United Kingdom. Foreman handles your customer messages on WhatsApp, answers inbound WhatsApp Business calls, and (where you opt in to phone-call coverage) answers inbound phone calls to a dedicated work number. Foreman also provides a dashboard for managing jobs, quotes, invoices, expenses and reviews.

Calls are recorded. Recording is core to how Foreman works — it is how Foreman returns to a conversation with full context, how the dashboard surfaces what was said, and how you can audit every interaction. Every call begins with a notice informing the caller that the call is handled by Foreman on your behalf and is being recorded; callers who do not consent can hang up and contact you directly. See section 9 below.

3. Eligibility

You must be at least 18 years old, operating a legitimate trade business in the United Kingdom, and entitled to enter into a binding contract.

4. Your account

You are responsible for keeping your login credentials safe and for everything that happens on your account. If you suspect unauthorised access, change your password and email hello@foremanai.trade immediately. One account per tradesperson.

5. Subscription and billing

  • Foreman is sold on a single monthly subscription. Current pricing is shown on foremanai.trade/pricing and confirmed at checkout. The subscription is billed monthly.
  • Payments are processed by Stripe. By subscribing you authorise recurring monthly charges at the price you accepted at checkout.
  • You can cancel at any time from inside the Foreman dashboard. Cancellation takes effect at the end of the current billing period. We do not refund partial months.
  • We may change the price with at least 30 days’ notice to your registered email address. If you do not accept the new price, cancel before it takes effect.
  • Failed payments will pause the service. Repeated payment failure for more than 14 days may result in account suspension.

6. Acceptable use

You agree not to use Foreman to:

  • Send spam or unsolicited marketing messages
  • Harass, threaten, or defraud anyone
  • Send messages to people who have not consented to be contacted (your customers must have an existing service relationship with you, or have initiated contact themselves)
  • Disable, suppress, or work around the pre-call notice. Every call answered by Foreman begins with a notice informing the caller that the call is handled by Foreman on your behalf and is being recorded. This notice is non-negotiable; tampering with it is a breach of these terms and of UK data-protection transparency obligations.
  • Impersonate another person or business
  • Bypass or attempt to bypass WhatsApp’s Business Messaging Policy or any other third-party platform’s rules
  • Reverse engineer, scrape, or attempt to access the service other than through the documented interface
  • Operate Foreman in any unlawful way

Breach of these rules may result in immediate suspension or termination of your account.

7. Customer data and data processing agreement

When you use Foreman to communicate with your end customers, you are the data controller of your customers’ personal data, and Foreman is the data processor acting on your instructions. You warrant that you have a lawful basis (UK GDPR Art. 6) to process each customer’s data — typically a contract or legitimate interest where there is an existing service relationship.

The processor terms required by Article 28 UK GDPR — covering confidentiality, security, sub-processor approval, international transfers, assistance with data-subject rights, breach notification, audit rights, and return or deletion of data — are set out in our Data Processing Agreement, which forms part of these Terms and is entered into automatically when you accept these Terms. By using Foreman to process your end customers’ personal data you agree to the DPA.

You are responsible for responding to your customers’ data subject requests. We will assist where reasonably necessary in line with the DPA.

8. WhatsApp and other third-party platforms

Foreman sends messages on your behalf via the Meta WhatsApp Business Cloud API. Your use of WhatsApp through Foreman is also subject to Meta’s WhatsApp Business Messaging Policy and Terms of Service. Where Foreman connects to Google Calendar or other third-party services, those services have their own terms which apply alongside ours.

9. Recorded calls

Every call answered by Foreman is recorded. Recording is the foundation of the service: it is how Foreman holds context across a conversation, how the dashboard shows you what was said, and how you can audit every interaction. This applies to inbound WhatsApp Business calls and, where you have enabled phone-call coverage, to inbound phone calls to your dedicated Foreman number.

Every call begins with a spoken notice informing the caller that the call is handled by Foreman on your behalf and is being recorded. A caller who does not consent can hang up at that point and contact you directly through your personal number.

Recordings and transcripts are stored and retained as described in our privacy policy. As the tradesperson using Foreman, you are responsible for ensuring that the customers you give your Foreman number to are aware that calls to that number are answered and recorded by Foreman — for example, by mentioning it on quotes, invoices, or your website.

10. Service availability

We aim to keep Foreman available 24/7 but do not guarantee uninterrupted service. We may schedule maintenance windows or roll out updates that briefly interrupt the service. Upstream outages (Meta, Stripe, Anthropic, Google) can disrupt functionality and are outside our control.

11. Intellectual property

The Foreman software, branding, and underlying intellectual property remain ours. Your data — your jobs, customers, messages, invoices, etc. — remains yours. You can export your data at any time by emailing us.

12. Termination

You can cancel your subscription and delete your account at any time from inside the dashboard. We can suspend or terminate your account with reasonable notice, or immediately for breach of these terms, non-payment, or activity that puts other users or our suppliers at risk. On termination we will delete your data in line with our privacy policy.

13. Liability

13.1 Cap. To the extent permitted by law, our total aggregate liability to you for any and all claims arising out of or in connection with these terms or your use of Foreman — whether arising in contract, tort (including negligence), breach of statutory duty, misrepresentation, restitution, or otherwise — is limited to the greater of £100 or the total fees you have paid us in the 12 months immediately before the event giving rise to the claim.

13.2 Excluded losses. Subject to clause 13.3, we are not liable, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, and whether the loss was foreseeable or not, for any of the following: any indirect, consequential, or special loss; any loss of profit, revenue, business, opportunity, goodwill, anticipated savings, contracts, or data; or any loss arising out of your failure to review, approve, or act on agent-generated outputs (including messages drafted, calls answered, or actions proposed by Foreman) before they take effect.

13.3 Liabilities we cannot exclude. Nothing in these terms limits or excludes any liability that cannot be limited or excluded under English law, including liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be limited.

13.4 No-warranty. Foreman is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, conditions, and representations of any kind, whether express or implied, including any implied warranty of satisfactory quality, fitness for a particular purpose, accuracy, completeness, or non-infringement. The agent uses artificial intelligence and its outputs may contain errors; you remain responsible for reviewing consequential outputs before they take effect.

14. Indemnity

You agree to indemnify us against any claim arising out of your misuse of Foreman, your breach of these terms, or your breach of the rights of any third party (including your customers).

15. Changes to these terms

We may update these terms. Material changes will be notified to your registered email address at least 30 days before they take effect. Continued use of Foreman after that date is acceptance of the new terms.

16. Force majeure

Neither party is liable for any failure or delay in performance caused by events outside its reasonable control, including but not limited to network outages, upstream API failures (Meta, Stripe, Anthropic, Google, Vapi, OpenAI, Resend), internet failure, acts of God, war, terrorism, civil unrest, regulator action, or pandemic. The affected party will use reasonable efforts to resume performance and will notify the other promptly.

17. Severability

If any provision of these terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions remain in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

18. No partnership or agency

Nothing in these terms creates a partnership, joint venture, agency, employment, or franchise relationship between the parties. Foreman acts as a software-service supplier on the tradesperson’s authorisation; Foreman is not the tradesperson’s agent in law and has no authority to bind the tradesperson except as expressly set out in these terms (e.g. messaging customers within the scope you have configured).

19. Entire agreement

These Terms of Service, together with the Privacy Policy and the Data Processing Agreement, constitute the entire agreement between the parties on the subject matter and supersede all prior representations, communications, and agreements (whether oral or written). Each party acknowledges that, in entering into these terms, it has not relied on any statement, representation, or warranty other than those expressly set out here. Nothing in this clause limits any liability for fraud or fraudulent misrepresentation.

20. Assignment

Foreman may assign or transfer these terms, or any rights or obligations under them, including in connection with a business sale, merger, restructure, or change of legal entity (e.g. incorporation as a limited company), and will notify the tradesperson of any such transfer. The tradesperson may not assign or transfer these terms or any rights under them without Foreman’s prior written consent (not to be unreasonably withheld).

21. Governing law

These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
